Freedom of Information Act

 

 The Freedom of Information Act (FOIA) generally provides that any person has a right to obtain access to federal agency records, except to the extent that such records, or portions of them, are protected from public disclosure by one of the nine exemptions or one of the three special law enforcement exclusions.

This website enables you to request records from the Naval Air Systems Command, Headquarters (NAVAIR) and the Naval Air Warfare Center, Aircraft Division (NAWCAD), Patuxent River. Requests for documents from these two commands can be sent via e-mail to NAWCADFOIA@navy.mil or by US mail to:

 Introduction to FOIA

 The Freedom of Information Act (FOIA) was enacted in 1966. Its purpose is to promote public confidence in the Government.

FOIA policy for the Federal Government is established by the Department of Justice (DoJ). The DoJ FOIA website contains numerous helpful references. Its main FOIA page can be found at www.usdoj.gov/oip/index.html . Individual Government agencies establish their own FOIA policies in accordance with the DoJ guidelines and relevant statutes and case law.

The Office of Counsel, NAWCAD, has a designated FOIA team which handles FOIA requests for NAVAIR and NAWCAD Patuxent River, Maryland. All requests for agency records from non-federal entities or persons are received and processed by the Office of Counsel's FOIA team.

FOIA requestors that have any questions or concerns regarding their requests submitted to NAVAIR or NAWCAD Patuxent River, should contact the POC in the acknowledgement letter (if received). For NAVAIR requests contact the NAVAIR FOIA paralegal at 301-342-9564. For NAWCAD requests contact the NAWCAD FOIA paralegal at 301-342-9563.

Selected Acquisition Reports (SARs) are inputted into the Defense Acquisition Management Information Retrieval system. OSD regularly releases all SARs. SARs may be found on the DOD Reading Room: http://www.dod.mil/pubs/foi/logistics_material_readiness/acq_bud_fin/SARs.html.

Seaport-e task orders (UIC: N00178) are required to be available on the contractor's website. Requesters are highly encouraged to check to see if the information on the website is acceptable. Federal Business Opportunities:

 Federal Business Opportunities (FedBizOpps) is a database of federal government contracting opportunities, including notices of proposed government procurement actions and contract awards.

In November 2003, all contracts issued by the Department of Defense began using the DoD Activity Address Code (DoDAAC) as part of the contract number (e.g. W9126G-04-D-0001; W9126G is the DoDAAC). Unfortunately, DoDAAC codes are not publicly available. However, Federal Business Opportunities (FedBizOpps) https://www.fbo.gov/, a site maintained by the General Services Administration (GSA), maintains many details pertaining to DoD and other Federal agency contracts.

To identify the DoD component responsible for a particular contract, you should access the FedBizOpps search page https://www.fbo.gov/index?tab=search&s=opportunity&mode=list.

To conduct a search, enter the first six digits of the contract number. If you prefer, you may enter the full contract number for a more exact search. In the "Documents to Search" section, select both for a more thorough search. For example, if you enter contract prefix, HQ0006, then SEARCH, you will note that the search produced, under Agency/Office/Location, the Missile Defense Agency, which is an activity supported by the OSD/JS FOIA Requester Service Center. In contrast, if you enter contract prefix, SPM4A7, you will see that the number is associated with the Defense Supply Center, Richmond, a component of the Defense Logistics Agency.
